AI systems now influence numerous sectors, from healthcare and finance to recruitment and law enforcement. These technologies are not neutral; they are shaped by the data they are trained on and the societal structures they operate within. Human-AI interaction—defined as the dynamic relationship between humans and AI systems—involves not just passive use, but ongoing feedback loops that evolve over time. This interaction creates new potential for discrimination, particularly when humans rely heavily on AI outputs or when AI systems reinforce existing social biases.

   

Discrimination and AI: Understanding the Intersection

  

The report provides an in-depth look at how discrimination can be embedded into AI systems in two primary ways:

  • Direct Discrimination: Occurs when an algorithm explicitly uses      protected characteristics (e.g., gender, race) in a harmful way. For      instance, an AI that directly filters out female applicants in job      recruitment would be engaging in direct discrimination.
  • Indirect Discrimination: This is subtler and more pervasive.   • Feedback Loops: AI systems learn from human behavior and      user data. If that data reflects biased human behavior (e.g., racially  biased police stops), the AI will inherit and potentially reinforce that      bias.
  • Reduced Accountability: When decisions are made or influenced by  AI, it can obscure responsibility. Was the bias due to the AI, the data,      or the human overseer? This opacity complicates redress and legal      recourse.

Structural and Systemic Risks

  

AI does not exist in a vacuum—it is developed, deployed, and operated within social systems that already have deep-seated inequalities. When these structural issues intersect with AI systems, discrimination can become systemic.

  • Data Issues: Most AI models rely on large datasets.      If these datasets reflect existing social inequities, the AI can entrench      them further. Lack of representation in data (e.g., fewer images of      darker-skinned individuals) leads to poorer performance for marginalized      groups.
  • Design Bias: Developers and engineers, often lacking      diversity, may unintentionally embed their own assumptions into AI      systems. Moreover, economic pressures to deploy AI quickly can      deprioritize fairness and ethical considerations.


Lack of Transparency: Proprietary algorithms and opaque design choices make it difficult for individuals or regulators to scrutinize or contest discriminatory outcomes. 

Case Studies: Real-World Examples of AI Discrimination

  

The report highlights several examples where human-AI interactions have led to discriminatory outcomes:

  • Recruitment Tools: AI-driven hiring tools have been found  to discriminate against women and minority applicants, often due to biased      training data or assumptions baked into the model.
  • Healthcare Algorithms: Algorithms used to prioritize patients  in the US were shown to favor white patients over Black ones due to the      use of health expenditure as a proxy for need, ignoring systemic      differences in access and treatment.
  • Facial Recognition: Numerous studies show that facial recognition systems perform worse on women and people of color. This can  lead to misidentification and harmful outcomes, especially in policing contexts.

These examples underscore the multifaceted ways discrimination can manifest through AI. 

Legal and Policy Context in the EU

  

The European Union has several legal frameworks relevant to discrimination and technology:

  • General Data Protection Regulation (GDPR): Protects personal data and includes      provisions for automated decision-making. Article 22 gives individuals the right not to be subject to decisions made solely by automated processes.
  • EU Charter of Fundamental Rights: Prohibits discrimination and enshrines dignity, privacy, and fairness—principles that AI systems must respect.
  • AI Act (Proposal): The EU’s proposed AI regulation introduces risk-based classification. High-risk AI systems (e.g., those  used in employment, policing, or education) will be subject to strict      obligations, including transparency, human oversight, and fairness      requirements.

While these frameworks are robust, the report warns that implementation, enforcement, and the fast-paced nature of AI development pose significant challenges.

Recommendations and Policy Options

  

To address the discriminatory risks of AI-human interaction, the report provides several key recommendations:


a) Ensure Transparency and Explainability

AI systems must be designed to be understandable not only by experts but also by end-users. “Black box” systems, especially those used in high-stakes decisions, should be auditable and explainable. This also involves improving documentation practices, such as model cards and data sheets for datasets.


b) Improve Data Governance

Better data practices are critical. This includes:

  • Using representative datasets.
  • Auditing data for bias before model      training.
  • Tracking data lineage to understand the      origins and transformations.

Data governance should be proactive, not reactive.


c) Promote Inclusive Design and Participation

Involving marginalized communities in AI design, testing, and deployment phases can ensure that systems are fairer and more responsive to diverse needs. Co-design practices and participatory AI methods are encouraged.


d) Strengthen Accountability Mechanisms

Clear lines of accountability must be established across the AI lifecycle—from developers and deployers to end-users. Regulatory bodies should have the authority to investigate, audit, and penalize discriminatory systems.


e) Develop Ethical Standards and Impact Assessments

Ethical impact assessments should be required for AI systems in sensitive domains. These assessments should analyze the potential for discriminatory impacts and include mitigation strategies. Ethical oversight bodies and advisory committees can also play a role.


f) Train Humans in AI Literacy and Bias Awareness

Since human-AI interaction is a two-way street, improving human understanding is essential. Users, especially decision-makers using AI tools, should be trained in AI literacy, ethics, and anti-discrimination principles.


g) Monitor and Evaluate Systems Post-Deployment

Ongoing monitoring of AI systems after deployment is necessary to detect and mitigate emergent discrimination. This includes establishing redress mechanisms for individuals affected by biased AI decisions.

   

A Broader Reflection on the Role of AI in Society

  The report ultimately encourages a broader societal conversation about the kind of future we want to build with AI. Key philosophical and ethical questions arise:

  • Should all decisions be automated?
  • What are the limits of human-AI delegation?
  • How can we build systems that reflect democratic values and protect the most vulnerable?

AI must be viewed not merely as a technical challenge but as a socio-political one. Equity, justice, and accountability must be core values embedded in the design, governance, and deployment of AI systems.
